HOW TO REQUEST FOR UPDATING OF RECORDS AND REGISTRATION OF LEGAL INSTRUMENTS

Description: This service caters to updating of records and registration of legal instruments such as using the surname of father, legitimation of marriage, supplemental report of birth.

1  Client/s: 1) Concerned person/s or Authorized representative;
2) For Supplemental Report of Birth the authorized person/s to file are only the following: a) Parent; b) Guardian; c) Party concerned (of legal age)

3  Location: Office of the City Civil Registrar (OCCR), Cebu City
4  Availability: Monday-Friday / 8:00 AM - 5:00 PM
5  Duration of the Service: 1 hour & 41 minutes
6  Requirement/s:
                               A. Affidavit to Use the Surname of the Father (R.A. 9255):
                                    a) Three (3) Original Copies (original signed) of the Affidavit to Use the Surname of the Father (AUSF), typewritten and duly signed by the father;
                                    b) Three (3) Original Copies of Affidavit of Consent of the Mother;
                                    c) Two (2) photocopies of birth certificate (Form 1A) or Certificate of Live Birth of the child;
                                    d) Any documents showing clearly the paternity between the father and the child (Strictly required when the name of the father does not appear in the birth record of the child):
                                           - Employment records (with beneficiaries);
                                           - SSS/GSIS records
                                           - Insurance
                                           - Statement of Assets and Liablities
                                           - Individual Income Tax Return of the father (ITR)
                                           - Others (showing relationship between father and child)
                                    e) Three (3) original copies of Affidavit of Acknowledgement/Recognition duly signed by the father (Strictly required when the father does not appear in the birth record of the child)
                                    f) Three (3) copies of Affidavit of Consent of the Child , if the child is 18 yrs. Old and above;
                                    g) Show valid of both parents (i.e. SSS/GSIS, Voter’s ID, Postal ID, Driver’s License, Passport, etc.)
                               B. Affidavit of Recognition (for birth records of those born before August 3, 1988):
                                    a) Three (3) original copies of Affidavit of Acknowledgement/Recognition duly signed by the father (must be typewritten/computer printout);
                                    b) One (1) original and two (2) photocopies of Birth Certificate (Form 1A) or Certificate of Live Birth;
                                    c) Any documents showing clearly the paternity between the father and the child, i.e.:
                                           - Employment Records (showing beneficiaries);
                                           - SSS/GSIS records
                                           - Insurance records
                                           - Statement of Assets & Liabilities
                                           - Income Tax Return (ITR)
                                    d) Show valid ID of the parents (i.e. SSS/GSIS ID, Voter’s ID, Postal ID, Driver’s License, Passport, etc.)
                               C. Affidavit of Legitimation by Subsequent Marriage:
                                    a) Three (3) original copies of Affidavit of Legitimation duly signed by the parents (must be typewritten/computer printout);
                                    b) Three (3) original copies of Affidavit of Recognition by the father (if the father’s name does not appear in the original birth certificate)
                                    c) One (1) original and two (2) photocopies of the Marriage Contract of the parents;
                                    d) Certificate of No Marriage CENOMAR, from the Office of the Civil Registrar-General (NSO) of both parents;
                                    e) Two (2) original copies of Birth Certificate (Form 1A) or Certificate of Live Birth;
                                    f) Any documents showing clearly the paternity between the father and the child
                                    g) Show valid ID of the father (i.e. SSS/GSIS ID, Voter’s ID, Postal ID, Driver’s License, Passport, etc.)
                               D. Supplemental Report of Birth:
                                    a) Three (3) copies of the Affidavit of Supplemental Report of Birth with the following facts enunciated therein:
                                           - Name of Document Owner
                                           - Date of Birth, Marriage or Death;
                                           - Registry Number
                                           - Entry/entries omitted during the time of registration
                                           - Reason for omission of the entry/ies during the event
                                           - Purpose in supplying the omitted data
                                    b) Two (2) photocopies of Certificate of Birth showing omitted data

7  Procedure in Availing the Service:

1. Submit required documents to the Court Orders/Judicial Decree Section Documents evaluated for sufficiency. Rupert Baoy 6 min.
2. Pay at Window 3. Issues Official Receipt (OR). CTO personnel 10 min.
3. Submit O.R. to Legal Instruments Section. 3.1. Receives OR and issues return slip.
3.2. Assigns Registry Number to Document.

4. Get return slip for scheduled release of annotated Civil Registry Document copy. 4.1. Records are searched from files
4.2. Updates documents & prepares and segregates 3 copies.
